Terms of Use

These Terms of Use ("Terms") are an agreement between you and ScrollStep ("ScrollStep", "we", "us" or "our") and govern your use of the ScrollStep app for iPhone (the "App") and the website scrollstep.com (together, the "Services"). By downloading, accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Services.

1. The Services

ScrollStep keeps the apps you pick open while you're moving. If you sit and scroll for too long, it nudges you and then pauses those apps until you walk the number of steps you chose. Reaching your daily step goal gives you a Free Pass for the rest of the day, and emergency minutes let you open your apps when you really need to.

The Services rely on Apple's Screen Time, Motion & Fitness and, optionally, Health features. If you turn these off, or iOS limits them, some features won't work. We may add, change or remove features at any time.

2. Stay safe while you walk

ScrollStep encourages you to move, not to stop paying attention. Don't use your phone while crossing streets, driving, cycling, on stairs, or anywhere you need your full attention. Stay aware of your surroundings at all times. You are solely responsible for your own safety and for following local laws while using the Services.

3. Not medical advice

ScrollStep is a wellness and habit tool, not a medical device. Step counts, distances, calories, food equivalents and projections are estimates, not medical, fitness or nutritional advice. Talk to a doctor before starting a new exercise routine, especially if you have a health condition, are pregnant, or have been inactive. Stop if you feel pain, dizziness or shortness of breath.

4. Eligibility

You must be at least 13 years old, or at least 16 in the UK, EU and EEA, to use the Services. If you're under the age of majority where you live, you may use the Services only with the permission of a parent or guardian, who agrees to these Terms on your behalf.

5. Accounts

An account is optional. If you sign in with Apple or Google, you're responsible for keeping that account secure and for all activity under it. Tell us right away at [email protected] if you think your account has been used without permission. You can delete your account at any time in Settings → Account.

6. Subscriptions, free trials and billing

• ScrollStep Pro is an auto-renewing subscription, offered monthly or yearly. Prices are shown in the App before you buy and may vary by country.
• Payment. Payment is charged to your Apple ID when you confirm your purchase. Apple processes all payments.
• Free trials. If a free trial is offered, you won't be charged until it ends. Unless you cancel at least 24 hours before the trial ends, your subscription starts automatically and you'll be charged.
• Automatic renewal. Your subscription renews automatically for the same length and price unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged within 24 hours before the period ends.
• Cancellation. You can cancel at any time in iOS Settings → your name → Subscriptions. Cancelling stops future renewals; you keep access until the end of the period you've paid for. Deleting the App or your account doesn't cancel a subscription.
• Refunds. Refunds are handled by Apple under its policies at reportaproblem.apple.com. We can't issue App Store refunds ourselves.
• Price changes. If the price changes, Apple will notify you in advance, and you can cancel before the new price applies.
• Special offers. Discounts, such as a reduced first-year price, apply only as described when they're shown, and only once per person.

7. Invites

When a friend starts ScrollStep with your invite code, they get extra free days and so do you, as described in the App at the time. Rewards are for genuine invites only. Self-referrals, fake accounts, and bulk or automated sharing aren't allowed, and we may cancel rewards we reasonably believe were gained unfairly. We can change or end the invite program at any time; rewards you've already earned stay valid.

8. Acceptable use

You agree not to:

• copy, modify, distribute, sell or lease any part of the Services
• reverse-engineer or try to extract the source code of the App, except where the law allows it
• bypass or interfere with subscriptions, security features or usage limits
• interfere with or disrupt our servers or networks
• use the Services for anything unlawful, harmful or fraudulent

9. Intellectual property and licence

The Services, including their design, code, text, graphics, name and logo, are owned by ScrollStep and protected by intellectual property laws. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, as permitted by Apple's Usage Rules. Share cards you create are yours to share. If you send us feedback or ideas, we may use them without any obligation to you.

10. Third-party services

The Services work with third-party services, including Apple (App Store, Screen Time, Health, Sign in with Apple), Google (Sign in with Google), Superwall (subscriptions) and Supabase (accounts). Your use of those services is also governed by their own terms and privacy policies. We aren't responsible for third-party services.

11. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don't guarantee that the Services will be uninterrupted, error-free or accurate, or that apps will always pause or reopen exactly as expected: iOS, permissions and device limits can affect how the Services work.

12. Limitation of liability

To the fullest extent the law allows, ScrollStep will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Services. This includes any injury or damage from using your phone while moving. Our total liability for any claim relating to the Services is limited to the amount you paid us for the Services in the 12 months before the claim.

Some places don't allow these limits, so they may not fully apply to you. Nothing in these Terms limits any rights you have as a consumer that can't be waived by law.

13. Indemnity

To the extent the law allows, you agree to indemnify and hold ScrollStep harmless from any claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Services or your breach of these Terms.

14. Termination

You can stop using the Services at any time. We may suspend or end your access if you break these Terms or if we're required to by law. Sections that by their nature should survive termination, such as intellectual property, disclaimers, limitation of liability and governing law, will survive.

15. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of Surat, Gujarat, India have exclusive jurisdiction over any dispute arising from these Terms or the Services, unless the consumer laws where you live give you the right to bring a claim in your local courts. Before starting any formal dispute, please contact us at [email protected] so we can try to resolve it informally.

16. Apple App Store terms

If you downloaded the App from the Apple App Store, the following also applies:

• These Terms are between you and ScrollStep only, not Apple. ScrollStep, not Apple, is solely responsible for the App and its content.
• Your licence to use the App is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent the law allows, Apple has no other warranty obligation with respect to the App.
• ScrollStep, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims that the App infringes their intellectual property rights, ScrollStep, not Apple, is responsible for investigating and resolving that claim.
• You confirm that you're not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you're not on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Apple's Licensed Application End User License Agreement also applies. If it conflicts with these Terms, these Terms apply, except where Apple's terms must take priority.

17. Changes to these Terms

We may update these Terms from time to time. We'll post the new version here and change the date at the top. If we make significant changes, we'll also let you know in the App. If you keep using the Services after the changes take effect, you accept the updated Terms.

18. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any right isn't a waiver of that right. You may not transfer your rights under these Terms; we may transfer ours as part of a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Services.
